NOTICE ON THE PROVISION OF THE SERVICE BEFORE THE WITHDRAWAL PERIOD HAS EXPIRED

Under Act No. 108/2024 Coll. of the Slovak Republic on Consumer Protection and on Amendments to Certain Acts, the following applies to a distance contract for the provision of a service where the consumer is to start receiving the service before the withdrawal period has expired:

§ 17(10) of Act No. 108/2024 Coll.
Before starting to provide a service under a distance contract or a contract concluded away from the trader’s business premises by which the consumer undertakes to pay the price, and before the withdrawal period under § 20 has expired, the trader is obliged to:

• a) inform the consumer that by starting the provision of the service before the withdrawal period has expired, the consumer loses the right of withdrawal once the service has been fully provided,
• b) obtain the consumer’s declaration that he or she has been informed under point (a), and
• c) obtain the consumer’s express consent to the start of the provision of the service before the withdrawal period has expired.

The loss of the right of withdrawal after such a service has been fully provided follows from the exceptions under § 19 of Act No. 108/2024 Coll. The withdrawal period for a distance contract is 14 days under § 20(1) of the same Act.

Proportionate payment. If you withdraw from the contract after the service has started but before it has been fully provided, you will pay a price proportionate to the extent of the performance already provided.

Express consent and declaration of the consumer

When submitting the order, the consumer ticks, separately, a box (not pre-ticked) with the following wording:

In accordance with the above, I give WEBISION s. r. o. my express consent to the start of the provision of the services before the withdrawal period has expired, and at the same time I declare that I have been duly informed that, by giving this consent, as a consumer I lose the right of withdrawal from the contract once the service has been fully provided, pursuant to § 19 in conjunction with § 17(10) of Act No. 108/2024 Coll. on Consumer Protection, as amended.
